DEFINITIONS

applicable laws and regulations; and

A booking is considered subject to these Terms & Conditions once payment is made or once you otherwise confirm your acceptance of the booking, unless expressly agreed otherwise in writing.

FAIRDEALS TRAVEL’S ROLE AS TRAVEL AGENT

FairDeals Travel generally acts as an agent, intermediary, booking facilitator or travel partner for third-party travel service providers.

We are not ordinarily the airline, hotel, cruise operator, car-rental company or railway service provider actually operating or supplying the underlying travel service.

Accordingly, the actual travel service may be subject to the Supplier’s own:

terms and conditions;
fare rules;
cancellation rules;
refund rules;
baggage rules;
check-in requirements;
passenger eligibility requirements;
identification requirements;
terms of carriage;
hotel policies;
rental conditions;
cruise conditions;
rail-ticket rules; and
other applicable policies.

The reference terms similarly establish that travel documents are issued subject to supplier conditions and that the travel agency acts as an agent.

By making a booking, you agree to comply with the applicable Supplier’s terms and conditions.

THIRD-PARTY SUPPLIERS

Travel services displayed or sold through FairDealsTravel.com may be provided by independent third parties.

These may include:

airlines;
hotels;
resorts;
cruise companies;
car-rental companies;
railway operators;
authorized rail-ticketing systems;
tour operators;
wholesalers;
consolidators;
Global Distribution System (GDS) providers;

The Supplier is responsible for providing the underlying travel service in accordance with its applicable terms.

FairDeals Travel will use reasonable efforts to assist customers with bookings, amendments, cancellations, refunds and supplier communications, where such assistance is available.

BOOKING CONFIRMATION

A quotation, itinerary, fare display or booking request does not necessarily constitute a confirmed booking.

A booking becomes confirmed only after:

the required payment has been received or authorized;
the relevant Supplier accepts the booking;
the reservation has been successfully processed; and
the applicable ticket, voucher, confirmation number or other booking document has been issued or confirmation has otherwise been provided.

Where applicable, FairDeals Travel may send the customer:

booking confirmation;
airline ticket;
hotel voucher;
car-rental voucher;
cruise confirmation;
rail ticket;
itinerary;
receipt; or
other travel documentation.

Customers should check all documents immediately after receiving them.

AVAILABILITY OF TRAVEL SERVICES

All travel products and services are subject to availability.

Availability displayed on our Website may change at any time.

A fare, room, vehicle, cabin, seat or other travel product may become unavailable before payment or ticket issuance.

We do not guarantee that a particular travel service will remain available until the booking is completed.

The reference terms similarly state that travel products are subject to availability and may be withdrawn without notice.

PRICES, FARES AND TAXES

All prices and fares are subject to availability and may change before confirmation and issuance.

Prices may include or exclude, depending upon the particular product:

base fare;
taxes;
airport charges;
government taxes;
carrier charges;
fuel surcharges;
service fees;
booking fees;
payment processing charges;
baggage charges;
seat-selection charges;
cancellation charges;
amendment charges;

The final price applicable to your booking will be communicated or displayed before completion of the transaction where reasonably practicable.

Unless otherwise stated, any additional charge imposed by a Supplier after booking may be payable by the customer where permitted under the applicable booking terms.

The reference terms also provide that fares may change until full payment and ticket issuance.

SERVICE FEES AND AGENCY FEES

FairDeals Travel may charge service, agency, convenience, booking, amendment, cancellation or administrative fees.

Such fees may apply to:

new bookings;
ticket issuance;
hotel reservations;
car rentals;
cruise bookings;
rail tickets;
cancellations;
amendments;
reissues;
refunds;
special customer-service requests; or
other travel-related services.

Any applicable FairDeals Travel fee may be communicated to the customer before the relevant transaction or may be included in the final booking price.

Supplier-imposed fees are separate from FairDeals Travel’s own service fees unless expressly stated otherwise.

PASSENGER AND TRAVELLER INFORMATION

You are responsible for providing accurate information for every traveller.

This may include:

full legal name;
date of birth;
gender where required;
nationality;
passport details;
identification details;
contact information;
travel dates; and
other information required by the Supplier.

For international travel, passenger names should generally match the applicable passport or travel document exactly.

The reference terms specifically warn that incorrect passenger names may result in denial of carriage or cancellation under carrier policies.

FairDeals Travel is not responsible for consequences resulting from inaccurate, incomplete or incorrectly entered traveller information, subject to applicable law.

PASSPORT, VISA AND ENTRY REQUIREMENTS

It is the traveller’s responsibility to obtain and maintain all documents required for travel.

Depending upon the journey, these may include:

valid passport;
visa;
transit visa;
electronic travel authorization;
residence permit;
vaccination or health documentation where legally required;
travel insurance;
return or onward ticket;
proof of accommodation;
financial documentation; and
other immigration or entry documents.

Visa and entry requirements may differ depending upon:

FairDeals Travel may provide general assistance or information where available, but the final responsibility for satisfying immigration, passport and entry requirements rests with the traveller.

FLIGHT BOOKINGS

Flight bookings are subject to the relevant airline’s:

fare rules;
conditions of carriage;
baggage allowance;
cancellation policy;
refund rules;
change rules;
no-show rules;
check-in requirements;
passenger identification requirements; and
other applicable conditions.

Airlines may change:

schedules;
flight numbers;
aircraft;
routes;
departure times;
arrival times;
terminals; or
other operational details.

FairDeals Travel will, where information is provided to us and reasonably practicable, communicate material changes to the customer.

The airline remains responsible for operating the flight and for decisions concerning flight operations.

FLIGHT CHECK-IN

Customers are responsible for completing check-in within the applicable time limits.

Depending upon the airline and route, online or airport check-in deadlines may apply.

Failure to check in on time may result in:

denied boarding;
cancellation of the booking;
forfeiture of fare;
additional charges; or
other consequences under the airline’s rules.

BAGGAGE

Baggage allowances are determined by the applicable airline, fare type, route and ticket conditions.

Additional baggage may be subject to separate charges.

FairDeals Travel is not responsible for baggage loss, damage, delay or restrictions imposed by an airline or other carrier, except to the extent liability cannot lawfully be excluded.

Customers should review the applicable carrier’s baggage rules before travel.

HOTEL BOOKINGS

Hotel bookings are subject to the hotel’s applicable:

check-in and check-out times;
cancellation policy;
no-show policy;
room conditions;
occupancy restrictions;
age restrictions;
identification requirements;
deposit requirements;
taxes and fees;
security deposit requirements;
additional guest charges; and
other property rules.

Photographs, descriptions, ratings and amenities displayed on the Website may be supplied by third parties or based on information provided by the relevant accommodation provider.

Actual facilities and services may change.

HOTEL CHECK-IN AND DEPOSITS

The hotel may require:

A cruise booking may have a separate deposit and cancellation schedule.

A car rental may have separate security-deposit and driver’s-licence requirements.

You are responsible for reviewing the terms applicable to each booking before confirming it.

Once a booking is confirmed, Supplier terms may restrict or prohibit cancellation, modification or refund.

The reference terms expressly recognize that advance-purchase and discounted products may have substantial cancellation/amendment fees or may be non-refundable.

CANCELLATION AND AMENDMENTS

Cancellation and amendment conditions depend upon the particular travel product and Supplier.

Before requesting cancellation or amendment, customers should review:

Supplier cancellation charges;
FairDeals Travel service fees;
fare difference;
reissue charges;
hotel cancellation charges;
cruise cancellation charges;
rail cancellation charges;
car-rental cancellation charges;
taxes and other non-refundable amounts.

A cancellation request does not automatically guarantee a refund.

The amount refundable, if any, will be determined according to the applicable Supplier rules and FairDeals Travel’s applicable fees.

REFUNDS

Where a refund is due, FairDeals Travel may process or facilitate the refund after receiving the applicable amount from the Supplier.

Refund processing times vary depending upon:

Supplier;
airline;
hotel;
payment method;
bank;
card issuer;
payment processor;
booking type; and
applicable refund procedure.

A refund may be reduced by applicable:

Supplier cancellation charges;
airline penalties;
hotel cancellation charges;
cruise cancellation charges;
rail cancellation charges;
car-rental charges;
FairDeals Travel service fees;
payment processing charges; and
other applicable deductions.

Where the Supplier determines that a booking is non-refundable, FairDeals Travel cannot promise a refund unless the Supplier or applicable law provides otherwise.

NO-SHOW

If a customer fails to use a booked service without properly cancelling it, the booking may be treated as a no-show.

No-show consequences may include:

loss of the ticket value;
cancellation of remaining flight segments;
loss of hotel reservation;
loss of car-rental reservation;
cruise cancellation;
rail-ticket forfeiture; or
additional charges.

The applicable Supplier’s rules will determine the consequences.

SUPPLIER CHANGES AND CANCELLATIONS

A Supplier may modify, cancel or otherwise change a booking because of circumstances including:

operational reasons;
weather;
safety;
technical issues;
regulatory requirements;
strikes;
natural disasters;
government restrictions;
airport or port restrictions;
schedule changes;
overbooking;
availability;
force majeure; or
other circumstances beyond our control.

Where we receive notice of a material change, we will use reasonable efforts to communicate the information to the customer.

Any refund, rebooking, alternative arrangement or compensation will be governed by the applicable Supplier’s rules and applicable law.

FORCE MAJEURE

FairDeals Travel shall not be responsible for failure or delay in providing assistance or processing a booking where the circumstances are beyond our reasonable control.

Such circumstances may include:

natural disasters;
pandemics or epidemics;
war;
terrorism;
civil unrest;
strikes;
government action;
border closures;
airport closures;
port closures;
railway disruptions;
severe weather;
technical failures;
telecommunications failures;
cyber incidents;
Supplier failure; or
other extraordinary circumstances.

Supplier-specific rights and remedies will remain governed by the applicable Supplier terms and applicable law.

TRAVEL INSURANCE

Customers are strongly encouraged to consider appropriate travel insurance.

Travel insurance may provide protection for circumstances such as:

medical emergencies;
trip cancellation;
baggage loss;
baggage delay;
travel interruption;
certain delays; and
other risks depending upon the insurance policy.

FairDeals Travel does not guarantee that any particular insurance policy will cover a particular loss.

The terms of the relevant insurance provider will apply.

THIRD-PARTY INFORMATION

Information displayed on FairDealsTravel.com may be provided by third-party Suppliers.

We make reasonable efforts to display information accurately, but we cannot guarantee that all third-party information will always be complete, current or error-free.

This may include:

other independent third parties.

However, nothing in these Terms & Conditions is intended to exclude or limit liability that cannot lawfully be excluded or limited.

Where liability of FairDeals Travel is legally established and a limitation is permitted by law, the maximum liability may, subject to applicable law, be limited to the amount actually paid to FairDeals Travel for the relevant service, excluding amounts retained or charged by third-party Suppliers.

This limitation does not apply where prohibited by applicable law.

INDIRECT OR CONSEQUENTIAL LOSS

To the extent permitted by law, FairDeals Travel shall not be liable for indirect, incidental, special or consequential losses arising from the use of the Website or a travel booking, including loss of profits, loss of business or additional expenses, except where such exclusion is prohibited by applicable law.

DESTINATION RISKS

Travel involves inherent risks.

By purchasing a travel service, you acknowledge that conditions at destinations may change because of:

weather;
political circumstances;

natural disasters;
security concerns;
government restrictions;
transportation disruptions; or
other circumstances.

Customers should independently review relevant government travel advisories and entry requirements before travelling.

FairDeals Travel does not guarantee that travel to any particular destination will be free from risk.

INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold FairDeals Travel and its officers, employees, agents and representatives harmless against claims, losses, liabilities, costs and reasonable expenses arising from:

TERMINATION OR SUSPENSION

legal or regulatory changes; or
other operational requirements.

For an existing confirmed booking, the terms applicable to that booking may continue to be governed by the terms communicated and accepted at the time of booking, subject to applicable law and Supplier requirements.

SEVERABILITY

If any provision of these Terms & Conditions is determined to be invalid, unlawful or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue in effect to the extent permitted by law.

NO WAIVER

If FairDeals Travel does not immediately enforce any provision of these Terms & Conditions, that does not constitute a waiver of our right to enforce that provision later.

ENTIRE AGREEMENT

These Terms & Conditions, together with the applicable booking confirmation, Supplier terms, fare rules, cancellation policies, Privacy Policy and any additional terms communicated to the customer, constitute the terms applicable to your use of FairDealsTravel.com and purchase of the relevant service, subject to applicable law.

Where Supplier-specific terms apply to a particular travel product, those terms will also form part of the booking arrangement.

RELATIONSHIP BETWEEN CUSTOMER AND FAIRDEALS TRAVEL

Nothing in these Terms & Conditions creates a partnership, joint venture, employment relationship or other relationship between FairDeals Travel and the customer other than the contractual/agency relationship applicable to the travel services purchased.

Where FairDeals Travel acts as an agent or booking intermediary, the relevant Supplier remains responsible for the underlying travel service.

GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted in accordance with the applicable laws of India.

Subject to applicable consumer-protection laws and other mandatory legal provisions, disputes arising from these Terms & Conditions shall be subject to the jurisdiction of the courts specified in the final version of this Agreement. Jurisdiction: India
